General Terms and Conditions of Business

§ 1 Scope

(1) These General Terms and Conditions apply to all contracts for consulting and training services between Pascal Hartmann-Boll (“Provider”) and the customers (“Customer”), unless otherwise agreed in writing.

(2) Any differing, conflicting or supplementary terms and conditions of the customer shall not become part of the contract unless their validity is expressly agreed to.

§ 2 Subject Matter of The Contract and Formation of the Contract

(1) The provider offers advice and training on psychosocial and professional issues.

(2) The contract is concluded by booking a service via the website or by email and the express acceptance by the provider. A binding contract is concluded upon booking a paid session.

(3) Booking is only permitted for persons of legal age.

(4) The customer will receive the invoice electronically after the service has been provided.

§ 3 Scope of Services And Prices

(1) The duration of the consultation is 60 minutes, unless otherwise agreed. The price per session is €120.00 including VAT.

(2) Bookings made with an access code are subject to individually agreed booking and cancellation conditions. These take precedence over the general terms and conditions.

(3) All prices are final prices in euros and include statutory VAT.

§ 4 Payment Terms

(1) Payment is made by invoice. This is due immediately upon performance of the service without deduction.

(2) The provider reserves the right to exclude certain payment methods.

§ 5 Right of Withdrawal

(1) Consumers have the right to withdraw from this contract within 14 days without giving any reason.

(2) The cancellation period is 14 days from the date of conclusion of the contract. To exercise the right of cancellation, a clear declaration must be sent to the provider (e.g. by email to info@hartmannboll.de or by mail).

(3) The right of withdrawal shall expire prematurely if the service has been fully performed and the customer has expressly agreed before the commencement of the service that the provider may begin performing the service before the expiry of the withdrawal period.

(4) In the event of a valid cancellation, payments already made will be refunded within 14 days.

§ 6 Liability

(1) The provider shall be fully liable for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty.

(2) Otherwise, liability for breaches of duty caused by slight negligence is excluded, unless they concern fundamental contractual obligations. In this case, liability is limited to the foreseeable damage typical for this type of contract.

§ 7 Data Protection

(1) Personal data is processed in accordance with the applicable GDPR. Details can be found in the privacy policy on the website.

(2) The customer has the right to information, correction and deletion of his data at any time.

§ 8 Jurisdiction and Applicable Law

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the customer is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction is Münster.

§ 9 Final Provisions

(1) Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

(2) The language of the contract is German.

(3) The provider reserves the right to amend these terms and conditions at any time. The version valid at the time of booking shall apply.
